The claim could defeat OpenAI’s fair-use defense and add wilful-infringement damages, the Authors Guild says.
The Guild’s brief cites a 2020 message in which an OpenAI policy director predicted the models would displace working writers.
“These filings reveal shocking disdain for writers and their work,” said Mary Rasenberger, the Authors Guild’s chief executive.
The case continues in federal court, with OpenAI and Microsoft yet to respond to the new filings.
